The Presidential Election Petition Court (PEPC), was forced into an abrupt adjournment on Monday due to the inability of the Independent National Electoral Commission (INEC) to produce its witnesses before the court in order to defend the petition that was filed by Peter Obi and the Labour Party (LP), against the declaration of Bola Ahmed Tinubu, as the winner of the presidential election that took place on February 25. The petition was filed in response to the fact that Tinubu had been declared the winner of the election, Vanguard reports.

Recall that on July 23, the legal team representing Obi and that representing the Peoples Democratic Party (PDP) brought an end to their presentation of evidence challenging INEC’ s declaration of Bola Ahmed Tinubu as the winner of the presidential election held on February 25.

The PEPC had postponed its meeting until Monday, July 3, so that INEC could begin their defence of the way the 2023 presidential election was carried out. However, when the court began its sitting on Monday, the legal team representing INEC, which was led by A. B. Mahmoud SAN, urged the court to postpone the proceeding till Tuesday, July 4, citing the fact that the three witnesses who were supposed to be summoned were dealing with personal matters that prevented them from being in court.

The attorneys who represent Obi, Tinubu, and the All Progressives Congress (APC) did not protest to the court’ s decision to delay the hearing. Following that, a five- member bench of the court presided over by Justice Haruna Tsammani adjourned the case to Tuesday.

Speaking with newsmen following the delay of the case, Obi’ s legal team, represented by Dr. Livy Uzoukwu (SAN), accused INEC of not being prepared to defend the 2023 presidential election.

In conclusion, He asserted that the poll was riddled with contradictions and inconsistencies and said, ” I am sure that they are not ready to defend this case. It is possible that I am mistaken, but I hope that they will defend this topic in order to bring more attention to it from the general public.

He remarked, ” I continue to say that we have never had an election like this last one. We have never had an election like this before. “
