CSU: Why Supreme Court can’t accept Atiku’s fresh evidence, says Tinubu
President Bola Tinubu has advanced reasons why the Supreme Court should reject the purported fresh evidence Atiku Abubakar and his party claimed to have obtained from the Chicago State University (CSU) in relation to his academic records.
Among other things, Tinubu contended that because the 180 days allotted for the hearing of the election petition have passed, the Supreme Court cannot now exercise trial jurisdiction in the matter.
In addition, Atiku and the Peoples Democratic Party (PDP), who were joint petitioners at the Presidential Election Petition Court (PEPC), did not challenge the outcome of the most recent presidential election on the grounds of forgery before the PEPC, the speaker continued, making the new evidence peculiar to the proceedings not only because it was not presented by the trial court……………………………….CONTINUE READING
According to The Nation, opeyemi Bamidele, the majority leader in the Senate, also pointed out that Atiku and the PDP never submitted any evidence documents or depositions from the CSU in support of their fourth basis, which related to Tinubu’s purported ineligibility before the PEPC.
If they did, according to Bamidele, Tinubu would have had the chance to answer appropriately and bring up the inconsistencies with Atiku’s credentials.
These are contained in the counter affidavit and written address filed by Tinubu, through his team of lawyers, led by Chief Wole Olanipekun (SAN) in response to the application by Atiku and his party seeking the permission of the Supreme Court introduce fresh evidence in their appeal.
